1. About these terms
Plumbz Pty Ltd (ABN 92 701 354 047), trading from Perth, Western Australia, provides plumbing, drainage, gas fitting and bathroom renovation services. References to “we”, “us” and “our” mean Plumbz Pty Ltd. References to “you” and “your” mean the customer who engages our services.
These terms, together with any written quote or scope of works we provide, form the agreement between you and us. If there is any inconsistency between a signed quote and these terms, the signed quote prevails to the extent of the inconsistency.
2. Quotes and estimates
- Written quotes are valid for 30 days from the date of issue unless otherwise stated.
- Quotes are based on the information you provide and a visual inspection where reasonably practicable. Concealed or latent conditions (such as corroded pipes behind walls, blocked or damaged underground drains, asbestos, or defective previous work) may not be apparent until work commences.
- Estimates provided without inspection are indicative only and are not a fixed price.
- Where we identify additional work required to complete the job safely and lawfully, we will advise you and obtain your approval before proceeding, except where urgent action is necessary to prevent damage, protect health, or comply with a legal or regulatory requirement.
3. Fees, payment and invoices
- Prices are quoted in Australian dollars and include GST where applicable.
- Unless otherwise agreed in writing, payment is due on completion of the work. For larger projects such as bathroom renovations, we may invoice in progress stages as set out in your quote.
- Payment may be made by the methods listed on your invoice. We do not accept cash payments at premises where we are working alone, for safety reasons.
- Overdue amounts may accrue interest and reasonable administrative and recovery costs, to the extent permitted by law.
- We may require a deposit or progress payment before commencing work or ordering materials, as set out in your quote.
4. Access and site conditions
- You agree to provide safe, reasonable access to the property and work areas at the agreed times, including access to water, power and, where required, meter points.
- You must tell us before work begins about any hazards on site, including asbestos, structural defects, live electrical issues, confined spaces, or pets that may pose a risk.
- You are responsible for clearing the work area of furniture, personal items and fragile goods unless we have agreed in writing to do so.
- If we cannot gain access at the agreed time, or the site is unsafe, we may charge a reasonable call-out or re-attendance fee.
5. Variations and unforeseen work
If, once work has commenced, additional work is required that was not reasonably foreseeable at the time of quoting (for example, discovering a failed sewer line during a bathroom renovation), we will pause the affected work, explain the issue, and provide a written variation for your approval. Work covered by a variation will be charged at the rates set out in your quote or, if not stated, at our reasonable standard rates.
6. Materials and products
- We supply materials and fixtures that meet Australian Standards and the requirements of the Plumbing Code of Australia and applicable Western Australian regulations.
- Where you supply your own fixtures or appliances, we will install them with care; however, we do not warrant products you supply, and we may advise you in writing if a supplied product is unsuitable, non-compliant, or likely to affect the performance of the installation. Installation of a product you supply at your request is at your risk in respect of that product.
- Manufacturer warranties on supplied products are in addition to your rights under Australian Consumer Law.
7. Workmanship warranty
In addition to your rights under Australian Consumer Law, we warrant our workmanship for a period of 12 months from completion of the work. If a defect in our workmanship appears within that period, contact us and we will return to rectify it at no charge. This warranty does not cover fair wear and tear, damage caused by misuse, alterations by others, blockages caused by items entering the drainage system, or defects in products manufactured by third parties, which are covered by the manufacturer’s warranty.
8. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund of the price paid, or a proportionate refund for the unused part of the service. You are also entitled to a reasonable refund for any other reasonably foreseeable loss or damage. For minor failures with the service, we are entitled a reasonable time to remedy the failure at our cost, or you may cancel the contract and obtain a refund of the price paid for the unused part of the service, or a proportionate refund.
Goods and products we supply may also come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
9. Limitation of liability
To the fullest extent permitted by law, and except as set out in section 8, our liability for any claim arising out of or in connection with our services is limited, at our option, to supplying the services again, or paying the cost of having the services supplied again. We are not liable for indirect or consequential loss, loss of profit, or loss of use of the property, except where such loss arises from our failure to comply with a consumer guarantee that cannot be excluded.
10. Cancellation and rescheduling
- You may cancel or reschedule a booked attendance by contacting us at ceo@plumbz.site. We ask for as much notice as possible; bookings cancelled with less than 24 hours’ notice may attract a reasonable cancellation fee.
- Where we have ordered custom or special-order materials for a renovation at your request, you remain responsible for the cost of those materials if the project is cancelled after ordering.
- If we need to reschedule due to illness, emergency call-outs, severe weather, or supply delays, we will notify you as soon as practicable and agree a new time with you.
11. Urgent and after-hours work
Urgent or after-hours attendance may be charged at different rates, which will be disclosed to you before work commences wherever practicable. In a genuine emergency where delay would cause significant damage or risk to health, we may take immediate action necessary to make the situation safe and will explain the work performed and its cost afterwards.
12. Compliance and certification
All plumbing and drainage work is performed in accordance with the Plumbing Code of Australia, relevant Australian Standards, and the licensing and notification requirements of the Western Australian plumbing regulatory framework. Where certification or compliance documentation is required for the work performed, we will provide it upon completion or as required by regulation.
13. Events beyond our control
We are not liable for delay or failure to perform our obligations where caused by events reasonably beyond our control, including severe weather, natural disasters, industrial action, utility failures, pandemics, or changes in law or regulation. Where such an event occurs, we will work with you to reschedule affected work as soon as reasonably possible.
14. Privacy
We handle your personal information in accordance with our Privacy Policy. Our privacy policy explains what information we collect, why we collect it, and how you can request access to or correction of your information.
15. Intellectual property
All content on this website, including text, design and branding, is owned by or licensed to Plumbz Pty Ltd. Plans, drawings, schedules and specifications we prepare for your project are provided for your use in connection with that project. You may not reproduce or reuse them for other purposes without our written consent.
16. Disputes and governing law
If you are unhappy with any aspect of our work, please contact us first at ceo@plumbz.site. We are committed to resolving concerns fairly and promptly and will work with you in good faith to reach an outcome. Formal complaints processes available under Western Australian building and consumer legislation remain open to you at all times.
These terms are governed by the laws of Western Australia and the Commonwealth of Australia, and the parties submit to the jurisdiction of the courts of Western Australia.
17. Changes to these terms
We may update these terms from time to time. The current version will always be published on this page with the date of last revision. The terms that apply to your engagement are the terms in effect at the time you accept a quote or engage our services, unless a later version is agreed in writing.
